Can I Take Time Off for Depression? FMLA, CFRA, California Disability, and Workplace Accommodations, Explained

Depression can support medical leave, wage-replacement benefits, or a workplace accommodation. These are different systems, and qualifying for one does not automatically qualify you for the others.

That distinction matters. California Disability Insurance may replace part of your wages but does not protect your job. The Family and Medical Leave Act and California Family Rights Act can protect eligible leave but do not themselves pay wages. Disability laws may require a reasonable accommodation even when a person does not qualify for family leave.

This guide uses official rules available on September 21, 2026. It is general education, not legal advice or a promise of approval. Employers, unions, benefit plans, and public agencies may offer additional rights.

Key takeaways

  • Depression is not an automatic leave approval. The symptoms must meet the rule for the benefit or protection being requested.
  • FMLA and CFRA can provide eligible workers up to 12 workweeks of job-protected leave for their own serious health condition.
  • California Disability Insurance, or DI, can replace part of eligible wages for up to 52 weeks, but it does not provide job protection.
  • The ADA and California FEHA may require reasonable accommodation unless it would cause undue hardship.
  • You usually do not need to give a manager your full therapy notes or medical record. Give the information the correct decision-maker is allowed to request.
  • If this article is used in 2027 or later, every EDD dollar amount and filing rule must be checked again.

Start with the result you need

Ask what problem you are trying to solve.

NeedWhere to look, and its limits
Time away with job protectionProgram to explore: FMLA and CFRA
What it may provide: Eligible unpaid leave and continued group health benefits under the applicable law
What it does not promise: Wage replacement
Income while medically unable to workProgram to explore: California DI
What it may provide: Partial short-term wage replacement for eligible workers
What it does not promise: Job protection
A change that lets you keep workingProgram to explore: ADA and FEHA accommodation
What it may provide: An effective reasonable change to the job or workplace
What it does not promise: The employee’s preferred option in every case
A few paid daysProgram to explore: Employer sick leave, PTO, union, or benefit plan
What it may provide: Pay under the plan or law
What it does not promise: Long-term leave in every case
Care for a family memberProgram to explore: FMLA, CFRA, or Paid Family Leave, depending on the facts
What it may provide: Leave protection, wage replacement, or both through separate systems
What it does not promise: Automatic eligibility for every relationship or condition

More than one program can apply at the same time. An employer may count the same absence under FMLA and CFRA when both cover it. California DI can pay wage replacement during a protected leave if its separate rules are met.

Can depression count as a serious health condition?

It can. Under FMLA, a mental health condition may qualify when it involves inpatient care or continuing treatment by a health care provider and makes the employee unable to perform an essential job function.1 CFRA also covers an eligible employee’s serious health condition under California law.2

A diagnosis by itself does not settle the question. A clinician may need to describe why symptoms such as severe loss of concentration, slowed thinking, panic, insomnia, medication effects, or suicidal risk prevent the person from doing essential work or require treatment.

Leave does not always mean one continuous absence. When medically necessary and properly certified, FMLA may be taken intermittently or through a reduced schedule. Examples might include a block of leave during an acute episode, a temporary shorter schedule, or time for treatment. The facts and certification determine what applies.

FMLA: the federal leave floor

The federal Family and Medical Leave Act can provide an eligible employee up to 12 workweeks of unpaid, job-protected leave in a 12-month period for the employee’s serious health condition. During covered leave, the employer generally continues group health benefits on the same terms.3

For most private-sector workers, the basic eligibility checks are:

  • At least 12 months of work for the employer
  • At least 1,250 hours worked during the 12 months before leave starts
  • A work location where the employer has at least 50 employees within 75 miles
  • An employer covered by FMLA

Public agencies and schools have additional coverage rules, so public employees should not stop at the private-employer test.

FMLA leave is unpaid, but available paid leave may sometimes run at the same time under employer policy and law. The right is to return to the same or an equivalent job, subject to the law’s rules and limited exceptions. FMLA does not make a layoff, misconduct rule, or job elimination disappear if it would have happened for a lawful reason unrelated to leave.

CFRA: California’s family and medical leave law

The California Family Rights Act applies to employers with five or more employees. An employee generally needs at least 12 months of service and 1,250 hours worked during the prior 12 months.2 Unlike the basic FMLA private-worksite test, CFRA does not require 50 employees within 75 miles.

CFRA can provide up to 12 workweeks of unpaid, job-protected leave for an eligible employee’s serious health condition. It can also cover care for a broader set of family members in some situations. This article focuses on leave for the worker’s own depression.

FMLA and CFRA often run at the same time when the same leave is covered by both. They do not usually become 24 weeks merely because two laws have names. There are situations where coverage differs, including pregnancy disability and certain family relationships, so individual review matters.

Under California rules, medical certification for the employee’s own serious health condition can support the need and expected duration without disclosing the diagnosis. A worker can choose to disclose more, but should understand who will receive it and why.2

California Disability Insurance: pay, not job protection

California Disability Insurance is part of State Disability Insurance, or SDI. It provides short-term wage replacement to eligible workers who cannot do their regular or customary work because of a non-work-related illness, injury, or pregnancy.4

For claims beginning in 2026, official EDD information states that eligible weekly benefits range from $50 to $1,765 and may continue for up to 52 weeks.4 The replacement rate is generally about 70% to 90% of wages, based on the claim’s rules and base-period earnings.5 A worker generally must have earned at least $300 in wages subject to SDI deductions during the base period.4

These are 2026 figures. A forecast is not a final benefit table. If this article is published or used in 2027, the editor must replace the figures with the official 2027 EDD table and recheck every linked rule.

DI does not protect the job. Job protection may come from FMLA, CFRA, FEHA, the ADA, a union contract, an employer policy, or another law. Apply for each protection or benefit that may fit.

The California DI filing timeline

The 2026 EDD process includes several timing rules:

  1. A claim generally has a seven-day unpaid waiting period. Benefits begin, if approved, with the eighth eligible day.6
  2. EDD instructs claimants to file no earlier than the ninth day after disability begins.
  3. File no later than 49 days after disability begins to avoid losing benefits, unless there is a good reason for delay.7
  4. The worker submits the claim, and a licensed health professional submits medical certification.

Do not wait until day 49 as a strategy. Collect the last day worked, date the disability began, employer details, and treatment contact. Use the current EDD instructions because forms and online steps can change.

Approval is not automatic because a clinician completes a form. EDD decides eligibility. A clinician should provide a truthful estimate based on current function and treatment, then update it if the clinical course changes.

Who can certify a California DI claim?

EDD lists several licensed professionals who may certify within their authorized scope. A nurse practitioner may certify disability within scope of practice. For a disability other than normal pregnancy and childbirth, EDD currently states that a nurse practitioner or physician assistant must perform a physical examination and collaborate with a physician or surgeon.8

That is an EDD program rule, not a statement that depression is unreal or that every psychiatric visit requires the same exam. The treating practice should follow the current EDD instruction and document what the form requires. An NP should not promise certification before assessing the patient, reviewing scope, and confirming the required collaboration.

Accommodations when you can still work

The Americans with Disabilities Act generally applies to employers with 15 or more employees. California’s Fair Employment and Housing Act generally applies to employers with five or more employees and can be more protective.910

Depression may be a disability when it substantially limits a major life activity under federal law or meets California’s broader definition. The focus is the functional limitation, not whether a person looks ill.

Possible accommodations can include:

  • a temporary modified or reduced schedule
  • adjusted start time after medication or insomnia changes
  • brief breaks for symptom management
  • a quieter workspace or fewer interruptions
  • written priorities and instructions
  • time for treatment appointments
  • remote work when it is effective for the role
  • a finite leave of absence
  • reassignment to a vacant position in some circumstances

An employer does not have to remove an essential job function, accept unsafe work, create a new job, or provide an accommodation that creates undue hardship. It may choose another effective accommodation instead of the exact one requested.

The employer and employee should take part in an interactive process. A useful request states the barrier and proposed change: “A medical condition is limiting concentration in a high-interruption setting. I am requesting a quieter workspace and written priority list for eight weeks while treatment is adjusted.”

What documentation should say

The best note is not always the longest. A work-status or accommodation document may need:

  • confirmation that a health condition creates a qualifying limitation
  • the work function affected
  • whether continuous leave, intermittent leave, or an accommodation is medically needed
  • the expected start, duration, and review date
  • appointment frequency if intermittent time is needed
  • functional limits and a return-to-work plan

It usually should not include psychotherapy notes, unrelated history, or a full chart. Send medical information to human resources, a leave administrator, or the designated benefits channel, not casually to a supervisor. Federal disability law requires medical information obtained through the accommodation process to be kept confidential, with limited exceptions.9

An employer may seek enough information to understand the disability and need for accommodation when they are not obvious. A vague note that says only “off work until further notice” may delay the process. A note that reveals every trauma can create needless privacy loss.

A decision path for the first week

If this is trueConsider this next step
You can work if one barrier changesMake a written accommodation request and start the interactive process
You need scheduled treatment timeAsk about intermittent or reduced-schedule FMLA and CFRA plus accommodation
You cannot perform essential duties for a defined periodAsk HR about protected leave and check DI wage replacement separately
You have no FMLA eligibilityStill check CFRA, FEHA, ADA, sick leave, union terms, and employer policy
You need incomeApply to EDD if eligible; leave approval does not start DI automatically
Work caused or worsened the conditionAsk a qualified professional about workers’ compensation; it is a separate system
You are in immediate dangerUse emergency or crisis care before forms

Keep copies of requests, certifications, deadlines, approval letters, and messages. Record dates and the person contacted. Do not secretly record conversations without first understanding California law.

Planning a return to work

Return is not a test of character. A full schedule on day one may be right for one person and destabilizing for another.

A practical plan can name:

  • the return date and schedule
  • temporary limits and their end or review date
  • appointment time
  • how workload will increase
  • who handles accommodation questions
  • early signs that require reassessment

Clinicians should describe work capacity, not manage the workplace. Employers decide operational issues within legal limits. The employee should not be asked to guarantee that symptoms will never return.

Common mistakes to avoid

Assuming DI holds the job. It pays benefits if approved. It does not create reinstatement rights.

Waiting for a crisis before contacting HR. Notice rules apply, and paperwork takes time. Give as much notice as practical when leave is foreseeable.

Sending the whole record. Use the narrow documentation the program lawfully needs.

Promising a fixed recovery date too early. Use a reasonable estimate and review date.

Resigning before checking rights. A resignation can affect job protection and benefits. Get individualized advice first when possible.

Treating an accommodation request as a demand for one solution. Describe the barrier, offer ideas, and take part in the interactive process.

When to get help now

Work paperwork is secondary when there is immediate danger. Call 911 or go to the nearest emergency department for a suicide attempt, immediate intent, severe self-neglect, psychosis, or an inability to stay safe. Call or text 988 in the United States for crisis support or help choosing the next step.

If safety is stable but symptoms are rapidly worsening, contact the treating clinician promptly. Ask for a clinical assessment first, then build documentation from the actual level of impairment.

Frequently asked questions

Is FMLA paid in California?

FMLA itself is unpaid. A worker may receive California DI, accrued paid leave, or employer benefits at the same time if each program’s rules are met.

Can my employer ask for my depression diagnosis?

The answer depends on the process. Employers may request appropriate certification or disability-related information in limited circumstances, but they generally are not entitled to an entire medical record. CFRA certification can support leave without naming the diagnosis. Get advice for a disputed request.

Can I use leave one day at a time?

Intermittent FMLA or CFRA may be available when medically necessary and properly certified. An accommodation can also involve schedule changes. Employer call-in rules still matter unless an emergency prevents compliance.

Can an NP complete California disability paperwork?

EDD allows a nurse practitioner to certify within scope. For non-pregnancy disability, its current rule also calls for a physical examination and collaboration with a physician or surgeon. The treating practice must confirm current requirements before submitting.

What if my employer has fewer than 50 employees?

Federal FMLA may not apply, but California CFRA and FEHA can apply at five employees, and the ADA generally applies at 15. Employer policy, sick leave, or a union agreement may add rights.

Can I be fired while on leave?

Protected leave and disability law restrict adverse action because of protected leave or disability, but they do not guarantee employment in every situation. The facts matter. Contact HR, a union representative, the California Civil Rights Department, the US Department of Labor, or an employment lawyer for an individual dispute.
